Switzerland’s Supreme Court has ruled that telco Swisscom cannot be forced to block access to international websites offering unlicensed content. The court dismissed a complaint from Praesens-Film, owner of Swiss rights to a number of films, which had asked Swisscom to block downloads or streaming access.
“The films aren’t offered by Swisscom, rather via third parties based in unknown locations in foreign countries,” the court ruled. “These parties are neither customers of Swisscom, nor do they have any other relationship to the telecom company.”
A lower court last year said Swisscom was not closely enough connected with the violation of Praesens-Film’s copyright, and was thus irrelevant for legal purposes.
The process has been viewed as a test case in Switzerland.
